A Legal Heir Certificate, also known as a Surviving family member certificate, is given out to demonstrate the correct legal heirs who were left behind by the deceased person. When applying for benefits from numerous organisations and government services where surviving members are favoured, this Certificate is typically requested as verification of surviving members. Survivor family members' names, ages, relationships to the deceased, and photographs are all included on a Legal Heir Certificate.

Benefits of Surviving family member certificate:
  • To establish a link with the deceased; 

  • To assert a claim to the deceased's movable and immovable property; 

  • To assert a claim to the deceased's employee benefits, such as family pensions, PF, gratuities, etc.;

  • To file a death insurance claim;

  • To benefit from additional government programmes.

It should be emphasised that a Legal Heir Certificate differs from a Succession Certificate or Letters of Administration and is not conclusive proof under Indian succession law.

Who May Apply?
  • Class 1 legal heirs include the deceased person's surviving husband, sons, daughters, and mothers.

  • In the event that no Class 1 legal heirs exist: Father and/or sibling

The Place To Apply:

By addressing the relevant Taluk/Tehsildar, one can obtain a Legal Heir Certificate or Surviving Member Certificate. Examples include The Surviving Member Certificate may be issued in Delhi by the SDM or Tehsildar of the relevant district.

Procedure and documentation:

The applicant(s) must submit a fully completed application form, the required fee (which varies depending on the area), and all required documentation, including but not limited to a death certificate, evidence of identity, and address for the applicant(s), a list of survivors with photos, etc.

Additionally, an affidavit from each surviving member must be included with the application.

Legal Heir Certificates or Surviving Member Certificates will be issued once the application has been submitted if the relevant authority is persuaded of its veracity based on the supporting documentation.

However, a designated officer conducts a field verification if the competent authority is not persuaded of the authenticity or veracity of the affixed documents. The competent authority reviews the field verification report that this officer submitted before deciding whether to approve the certificate or reject the application.

The applicant(s) in Delhi may also apply for the certificate online. The service can only be accessed after an applicant has registered on the web platform using their Aadhar Card or Voter ID card.

Typically, the complete process takes 10 to 14 working days.
