What is Right to Property ?According to the Article 300A in the Constitution of India, Right to Property is a constitutional right of the citizen. The law states that each individual has the right to own a property in India.
What is the position of Right to Property in India ? Then :
Right to Property is a legal right of citizens of India. According to Article 13 of the Indian Constitution. Right to Property could be classified as a Fundamental Right .This meant that the Indian Constitution had previously guaranteed the right of private ownership. Further it also guaranteed that a citizen will have the right to enjoy and dispose of property free from restrictions other than reasonable restriction. If the personal property of a citizen is taken for public purpose, a compensation will be provided to the citizen.
Now :According to the Forty-fourth Amendment Act of the constitution. Right to Property was deleted as a fundamental right. The Amendment omitted Article 31 and Article 19 (1) (f) and inserted in their place Article 300-A.
