I understand your concern here but you know it is a little difficult. I was in a similar situation where I had already signed the agreement but decided to not move in. I asked my acquaintances who live in rented accommodations can I get my deposit back if I change my mind and they responded negatively. Honestly, I was scared of losing my money so I contacted a lawyer friend of mine to take his opinion. He explained to me a few scenarios, I can share them with you.
Scenario 1: You have made the deposit but didn’t sign the agreement yetIf you have just made the deposit and not signed an agreement yet, you can simply ask your broker to get your deposit back from the landlord since there has been no legal binding as yet. It should be easy and if that doesn’t work, you can ask for legal advice from a lawyer, it won’t cost you much.
Scenario 2: You have made the deposit and signed the agreement with the landlord but now you have changed your mindThis one’s tricky. See, when you are in a legally binding contract, you cannot break it. In that case the landlord has all the rights to keep the deposit with himself/herself. This is because he will not be receiving the rent from you for the said time period. Yet you say that the previous tenant is living there, you can reason with the broker or landlord and explain your reasons for calling off the contract.
If you are someone with scenario 2, there is nothing much that you can do than to convince them politely. However, in the first case, you can try everything and maybe consult a lawyer or go to the police for help.

What should I do if the landlord is refusing to return the deposit after I cancel the deal? The apartment was occupied by previous tenant after cancellation, so no loss for owner. Broker is refusing to give owner’s contact.
