I talked to my lawyer friend about legal heirs when my grandfather died last year. He told me that there are several statutes and different personal laws governing the issue of succession, divorce, and marriage. Over matters like inheritance, insurance, identifying a legal heir is significant as they’re the ultimate successor over insurance claims and over the property under inheritance. Let me tell you who are legal heirs of deceased in India:

When a person dies intestate (without a Will), the appropriate succession laws come into effect for transferring assets held by the person to the legal heirs.

Legal heirs can be categorized into 2 segments:

  • Class I heirs

  • Class II heirs

For example,

As per the Hindu succession law, if a Hindu man leaves behind property without a Will, it will be passed on to Class I heirs (the mother, children, and widow) in equal shares. In case there are not any Class I heirs, the property can be claimed by the Class II heirs (sister, brother, father, grandchildren, great grandchildren, and other relatives).

If the owner is a Hindu woman, then her children and husband get the property in equal proportion. If they are not present, then the property will go to her husband’s heirs. Failing that, it’ll go to her parents.
