When you are a part of the housing society committee, you get to know a lot about laws pertaining to a housing society and rules which have been laid out by the government. If you ever wondered who can become chairman of housing society or how people decide powers and roles of housing society then let me tell you, it all depends on the model by laws of your state. I am going to tell you about who can become chairman of housing society as per the general laws stated by the Central Government of India. I am also going to share what are the roles of chairman in a housing society.

Who can become chairman of housing society?

So basically, a chairman of the housing society is elected by the board of directors of the committee. Anyone who is a member of the housing society can become the chairman. However, there are a few people who don’t qualify for the vacancy.

According to the model bye laws, these are the individuals who cannot be chairman of the housing society:

  • A member of the board shall not be eligible for chairman or vice- chairman vacancy if he/ she is a Minister in the Central or State Government

  • The member of the committee shall not be elected as Chairperson or President if he/she  has held the office during two consecutive terms (full or part).

What are the powers and responsibilities of a chairman?

According to the bye laws, here is a list of roles and responsibilities of the chairman:

  • A chairman shall preside over the meeting of the general body, Board of Directors and executive committee

  • He/she must sign the proceedings of all the meetings presided by them

  • In case of a tie in votes, a resolution vote will be cast by the chairman

  • He /she shall convene the meeting of the Board of Directors, Executive Committee and other committees of which he/she is the Chairman

  • A chairman can delegate any of his powers and functions to the VC

The chairman of a cooperative housing association oversees and directs the management committee. The housing society chairman responsibilities are numerous. President and Chairman are both names for the same position. The MCS Act's norm states that the post chairmanship must never be vacant.

In a housing cooperative, the apartment management committee serves as the organisation's brain, guiding the community toward a healthy, effective, and peaceful way of life. The apartment management committee must function like a well-oiled machine to provide the finest living conditions for the residents, whether it is handling finances, member complaints, or day-to-day business.

I would completely agree with the roles which are highlighted by Nimish in his answer. I’d like to add a few more roles of the society chairman.

What are the society chairman duties and responsibilities?

No authority comes without associated obligations. The two are inseparable and, in a real sense, born from one another. The role of chairman in society involves an array of responsibilities being the head of the society.

The housing society chairman responsibilities are as follows;

  • The chairman is in charge of managing the society as a whole.

  • The chairman is in charge of monitoring the society's efficient and trouble-free operation.

  • The chairman is the one who must answer to the entire society in the event of any mishaps or miscreants, and he or she must assume all associated obligations.

  • The chairman must make sure that all society records are accurately updated and preserved.

  • The chairman must make sure that the annual audit of the society's financial records is completed on time.

  • The chairman must see to it that the society's annual general meeting takes place on or before the specified date of August 14 each year.

  • The Chairman is in charge of organising the Management Committee's monthly meeting.

  • The chairman must periodically organise social gatherings and welfare events for the community.

  • In an emergency, the chairman must assume any additional duties that the management committee has, outside his own.

I’d like to conclude here about the housing society chairman responsibilities. I hope this helps:)
