would like to get your esteemed opinion regarding a legal point with respect to apartment. I live in an apartment in Chennai which I bought 12 years back. The apartment has 6 flats and 4 covered parking. Out of it, the builder sold all the flats but allocated only 3 parking to the flats (based on the size order) and has been holding and using one car parking for his personal use from day one ; which ideally should have been allocated to my flat based on the size. The Builder is claiming that he hasn't sold the 4th car parking and hence holds the complete rights to it. I would like to know if it is legally right for the builder to do so ?

Hi Srihari,

I would advice to get your property papers verified by a lawyer who could advise you in the best possible manner if the parking is separately owned by the builder or that too is a part of your property.

There must be clauses mentioned in the papers for the same.
